(b) Composition; appointment and terms of members;
chairman; vacancies. —The Board consists of seven members
appointed for a two year term by the Governor, with the
advice of the Secretary OF HEALTH AND MENTAL HYGIENE, and
the advice and consent of the Senate. The representation of
four of the seven appointments shall be as follows: one from
the Eastern Shore, which comprises the counties of Caroline,
Cecil, Dorchester, Kent, Queen Anne's, Somerset, Talbot,
Wicomico, and Worcester; one from central Maryland, which
comprises Baltimore City and the counties of Baltimore,
Carroll, Harford, Howard, and Montgomery; one from southern
Maryland, which comprises the counties of Anne Arundel,
Calvert, Charles, Prince George's, and St. Mary's; and one
from western Maryland, which comprises the counties of
Allegany, Fredericks Garrett, and Washington. A regional
appointee shall be a licensed well driller actively engaged
at the time of his appointment in the well-drilling business
in the State. The Governor shall appoint the remaining
three members of the Board upon the recommendation of the
Secretary OF HEALTH AND MENTAL HYGIENE and with the advice
and consent of the Senate, as follows: one from the public
at large, who shall serve as the chairman; one from the
Department OF NATURAL RESOURCES; and one from the Department
of Health and Mental Hygiene. If there is a vacancy, with
the advice of the Secretary OF HEALTH AND MENTAL HYGIENE,
the Governor shall appoint a successor to serve for the
remainder of the unexpired term. A MEMBER AS OF JUNE 30,
1980, SHALL REMAIN A MEMBER FOR THE BALANCE OF THE TERM TO
WHICH THE MEMBER WAS APPOINTED, UNLESS THE MEMBER DIES,
RESIGNS, OR IS REMOVED PURSUANT TO LAW.

(d)  Powers and duties generally; authority to make
rules and regulations. — The Board shall administer and
enforce Part III of this subtitle and has the powers
expressly conferred or reasonably implied from this title.
The Board may make and enforce rules and regulations to
carry out the provisions of Part III of this subtitle. The
Board shall review the rules and regulations submitted to it
by the Department OF HEALTH AND MENTAL HYGIENE for Board
comment before adoption by the Department.

(e)  Executive director and other personnel;
qualifications of executive director; tenure and
compensation of employees. — The Board may employ a
secretary and other assistants necessary to assist in
discharging its duties. It also may employ and discharge at
its pleasure an executive director. The employment or
removal of the executive director and any other personnel is
subject to the approval of the Secretary OF HEALTH AND
MENTAL HYGIENE. The executive director shall possess a
broad knowledge of the business of well drilling. He shall
devote his entire time to the duties of his office, and may
not hold any other position or occupation or engage in any
other business which would interfere with the work of his
office or appear to be inconsistent with the duties and
responsibilities of his position. The executive director
and other employees shall have the compensation provided in
the State budget.
