8-604.

A well may not be drilled until [a permit has been
obtained under this subtitle] THE DEPARTMENT OF HEALTH AND
MENTAL HYGIENE ISSUES A PERMIT TO DRILL A WELL. In applying
for a permit, the driller shall give the Department of
Health and Mental Hygiene the information it requires. As a
condition to issuing a permit, the Department of Health and
Mental Hygiene may require samples of the materials
encountered in drilling the well to be preserved and
submitted to it. On completion of the drilling of any well,
the driller shall file a final report with the Department of
Health and Mental Hygiene giving the log of each well, size
and depth, diameters and lengths of casing and screen
installed, static and pumping levels, yield of the well, and
any other information pertaining to construction or
operation of the well the Department of Health and Mental
Hygiene requires.

REVISOR'S NOTE: Ch. ____, Acts of 1981, which enacted

Titles 20 and 21 of the Health Occupations
Article, also amended the first sentence of this
section to clarify that the Department of Health
and Mental Hygiene issues a permit to drill a
well.

SECTION 4. AND BE IT FURTHER ENACTED, That the
Revisor's Notes and catchlines contained in this Act are not
law and may not be considered to have been enacted as a part
of this Act.

SECTION 5. AND BE IT FURTHER ENACTED, That nothing in
this Act affects the term of office of an appointed or
elected member of any department, board, commission,
committee, agency, or other unit. A person who is a member
of such a unit on the effective date of this Act shall
remain a member for the balance of the term to which
appointed or elected, unless the member sooner dies,
resigns, or is removed under provisions of law.

SECTION 6. AND BE IT FURTHER ENACTED, That except as
expressly provided to the contrary in this Act, any
transaction affected by or flowing from any change of
nomenclature or any statute there amended, repealed, or
transferred, and validly entered into before the effective
date and every right, duty, or interest flowing from the
statute remains valid after the effective date and may be
terminated, completed, consummated, or enforced as required
or permitted by any statute amended, repealed, or
