(c)(D) NOTWITHSTANDING ANY PROVISIONS TO THE CONTRARY,
A COUNTY BOARD OF HEALTH HEALTH DEPARTMENT BOARD OF HEALTH,
DELEGATED BY THE DEPARTMENT OF HEALTH AND MENTAL HYGIENE TO
IMPLEMENT A WELL INSPECTION PROGRAM, MAY IMPOSE COLLECT A
FEE FOR THE ISSUANCE OF WELL PERMITS REQUIRED UNDER §
8-604(A) OF THIS TITLE 9-1307 OF THIS SUBTITLE. HOWEVER, A
COUNTY HEALTH DEPARTMENT MAY NOT IMPOSE COLLECT A FEE FOR
TEST OR IRRIGATION WELLS.

8-604.

(A) A well may not be drilled until the Department of
Health and Mental Hygiene issues a permit to drill a well.
In applying for a permit, the driller shall give the
Department of Health and Mental Hygiene the information it
requires. As a condition to issuing a permit, the Department
of Health and Mental Hygiene may require samples of the
materials encountered in drilling the well to be preserved
and submitted to it. On completion of the drilling of any
well, the driller shall file a final report with the
Department of Health and Mental Hygiene giving the log of
each well, size and depth diameters and lengths of casing
and screen installed, static and pumping levels, yield of

the well, and any other information pertaining to

construction or operation of the well the Department of
Health and Mental Hygiene requires.

9-1307.

(a) In applying for a permit to drill a well, the well
driller shall give the Department any information the
Department requires.

(b) As a condition to issuing a permit to drill a
well, the Department may require that samples of the
materials encountered a drilling the well be preserved and
submitted to the Department.

(B)(C) A COUNTY BOARD OF HEALTH MAY ESTABLISH A PERMIT
FEE TO DEFRAY COUNTY EXPENSES IN INSPECTING WELLS. THE FEE
MAY BE CHARGED BEFORE A PERMIT REQUIRED UNDER SUBSECTION (A)
§ 9-1306 OF THIS SECTION SUBTITLE IS ISSUED. THE FEE MAY
NOT EXCEED $50 PER WELL. UNTIL JULY 1, 1983 THE FEE MAY NOT
EXCEED $25 $20 PER WELL AND ON OR AFTER JULY 1, 1983 THE FEE
MAY NOT EXCEED $50 $40 PER WELL.

(C) (D) A COUNTY BOARD OF HEALTH MAY WAIVE A FEE FOR A
WELL THAT IS DRILLED TO REPLACE A WELL NOT IN CONFORMITY
WITH THE REGULATIONS ADOPTED UNDER § 8-602 9-1307 OF THIS
TITLE SUBTITLE.
