shall take effect July 1, 1982.

CHAPTER 697

(House Bill 1291)

AN ACT concerning

Fire Marshal

FOR the purpose of transferring the method of appointing the
State Fire Marshal to appointment by the Secretary of
the Department of Public Safety and Correctional
Services from a list submitted by the State Fire
Prevention Commission; transferring the power of
removal of the Fire Marshal to the Secretary; requiring
the Secretary to give a certain notice; correcting an
error; allowing the Commission to recommend the removal
of the Fire Marshal for cause; and generally relating
to the powers of appointment and removal of the State
Fire Marshal.

BY repealing and reenacting, with amendments,

Article 38A - Fires and Investigations

Section 7(a)

Annotated Code of Maryland

(1978 Replacement Volume and 1981 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
read(s) as follows:

Article 38A - Fires and Investigations

7.

(a) The office of State Fire Marshal is established
as part of the Department of Public Safety and Correctional
Services. The [State Fire Prevention Commission shall, with
the approval of the] Secretary of Public Safety and
Correctional Services[,] SHALL appoint a State Fire Marshal
for a six-year term FROM A LIST OF 3 NAMES SUBMITTED BY THE
STATE FIRE PREVENTION COMMISSION. He is not subject to the
provisions of Article 64A of this Code, but he can be
removed by the [Commission, with the approval of the]
Secretary of Public Safety and Correctional Services, at any
time for neglect of duty, or other conduct unbecoming his
