(ii) The person for whom the drugs are
prescribed is. a patient of the prescribing dentist, physician, or
podiatrist;

(iii) The dentist, physician, or podiatrist
does not have a substantial financial interest in a pharmacy; and

(iv) The dentist, physician, or podiatrist:

1.  Complies with the labeling
requirements of § 12-510 of this title; and

2.  Records the dispensing of the
prescription drug on the patient's chart or as otherwise
permitted or required by the board that licensed the dentist,
physician, or podiatrist[.]; OR

(3) A hospital-based clinic from dispensing
prescriptions to its patients.

DRAFTER'S NOTE: This corrects an error in punctuation and
the omission of a conjunction in § 12-102(b) of the
Health Occupations Article.

The error in punctuation, the use of a period in the
place of a semicolon after a listed item occurred in
Ch. 691 of the Acts of 1986. The disjunctive
conjunction, "or", was also omitted from Ch. 691 of
the Acts of 1986.

The error in punctuation and the omission of the
conjunction were noted by the Michie Company.

12-409.1.

(a) If after a hearing under § 12-410 of this subtitle the
Board finds that there are grounds under § 12-409 of this
subtitle to suspend or revoke a [license] PERMIT, the Board may
impose a penalty not exceeding $5,000:

(1)  Instead of suspending the [license] PERMIT; or

(2)  In addition to suspending or revoking the
[license] PERMIT.

DRAFTER'S NOTE: This corrects an error in a reference in §
12-409.1(a) of the Health Occupations Article.

Title 12, Subtitle 4 of the Health Occupations Article
provides for the issuance of pharmacy permits, not
licenses.
