WILLIAM DONALD SCHAEFER, Governor

D.  On February 1, 1988, the responsibility for
administration of any unexpected or carry over funds derived
from formula or discretionary grants authorized by the Act
shall be transferred from the Juvenile Services Agency to
the Governor's Office [for Children and Youth]:

(1)  On and after February 1, 1988, the Governor's
Office [for Children and Youth] shall exercise all functions
related to the fiscal administration of the Act as provided
in the budget; and

(2)  The fiscal administration of the Act refers to
such functions as meeting annual planning requirements,
financial accountability, financial audit, and monitoring
and evaluation of subgrants.

E.  The Governor's Office [for Children and Youth] shall
administer such operating funds as the Council is entitled
to under Section 222 of the Act:

(1)  The Governor's Office [for Children and Youth]
with the advice of the Chairman of the Council, may hire a
staff person(s) to provide such support and perform such
duties as deemed appropriate. The staff to the Council will
report to the Director of OPERATIONS FOR the Governor's
Office [for Children and Youth]; and

(2)  The Governor's Office [for Children and Youth]
may provide the Council with such additional staff support,
services and technical assistance as necessary and as
provided in the State budget.

F.  THE GOVERNOR SHALL ENSURE THAT THE STATE OF MARYLAND
COMPLIES WITH THE REQUIREMENTS SET FORTH BY THE FEDERAL
OFFICE OF JUVENILE JUSTICE AND DELINQUENCY PREVENTION IN
REGARD TO THE REMOVAL OF JUVENILES FROM ADULT JAILS AND
LOCKUPS, IN A MANNER THAT IS CONSISTENT WITH SECTION
222(A)(14) OF THE ACT:

(1)  THE APPROPRIATE BRANCHES OF STATE GOVERNMENT
SHALL COMPLY WITH § 3-814 AND § 3-815 OF THE COURTS AND
JUDICIAL PROCEEDINGS ARTICLE OF THE ANNOTATED CODE OF
MARYLAND.

(2)  TO THE EXTENT FEASIBLE, THE LOCAL GOVERNMENTS,
THE STATE AND LOCAL LAW ENFORCEMENT UNITS, AND THE MEMBERS
OF THE JUDICIAL SYSTEM SHALL SUPPORT THE STATE IN ITS
EFFORTS TO PREVENT JUVENILES FROM BEING PLACED IN ADULT
JAILS AND LOCKUPS.
