(4) Accident reports and abstracts of court convictions pertaining to driving
an em
ergency vehicle, if received by a person who was driving an emergency vehicle
pursuant to the provisions of § 21-106 of this articl
e, shall be segregated by the
Administration and shall b
e available only to the Administration.

(5) Except as provided in this section, an employee of the Administration
may not disclose any record
s or information regarding probation before judgment, or a
first offense of driving with an alcohol concentration of 0.10 or more under § 16-205.1 of
this article.

(c) If a charge of a Maryland Vehicle Law violation against any individual is
dismi
ssed by a court of competent jurisdiction, a record of the charge and dismissal may
not be includ
ed in his driving record.

(D) (1) EXCEPT AS PROVIDED IN PARAGRAPH (2) OF THIS SUBSECTION, AN
EMPLOYEE OF THE ADMINISTRATION MAY NOT MAKE A DIGITAL PHOTOGRAPHIC
IMAGE AND SIGNATURE AVAILABLE TO THE GENERAL PUBLIC.

(2) A DIGITAL PHOTOGRAPHIC IMAGE AND SIGNATURE OF AN
INDIVIDUAL MAY BE MADE AVAILABLE ONLY TO:

(I) THE ADMINISTRATION;

(b) (1) Except as otherwise provided by law, all records of the Administration
are public records and open to public inspection during office hours.

(2)      Subject to paragraph (4) of this subsection, in his discretion, the
Administrator may classify as confidential and not open to public inspection any record or
record entry:

(i) That is over 5 years old; or

(ii) That relates to any happening that occurred over 5 years earlier.

(3)      Any record or record entry Of any age shall be open to inspection by
authorized representatives of any federal, State, or local governmental agency.

(4)      Subject to paragraph (3) of this subsection, the Administrator may not
open to public inspection any record or record entry that is:

(i) All or part of a licensed driver's public driving record; and

(ii) Over 3 years old.

(5) SUBJECT TO PARAGRAPH (6) OF THIS SUBSECTION, THE
ADMINISTRATION MAY NOT PERMIT PUBLIC INSPECTION OF A DIGITAL
PHOTOGRAPHIC IMAGE OR SIGNATURE OF AN INDIVIDUAL, OR THE ACTUAL
STORED DATA THEREOF, RECORDED BY THE ADMINISTRATION.

(6) THE ADMINISTRATION MAY MAKE A DIGITAL PHOTOGRAPHIC
IMAGE OR SIGNATURE OF AN INDIVIDUAL, OR THE ACTUAL STORED DATA
THEREOF, RECORDED BY THE ADMINISTRATION AVAILABLE TO:
