NOTHING IN THIS TITLE MAY BE CONSTRUED TO RESTRICT OR REQUIRE
ACTION TAKEN IN ACCORDANCE WITH THE EDUCATION ARTICLE OF THE
ANNOTATED CODE OF MARYLAND:
(1) BY FEDERAL, STATE, OR LOCAL GOVERNMENTS, RELIGIOUS
INSTITUTIONS, OR CHARITABLE ORGANIZATIONS THAT OPERATE IN THIS STATE;
(2) IN ACCORDANCE WITH THE EDUCATIONAL ARTICLE OF THE
ANNOTATED CODE OF MARYLAND; OR
(3) BY ANY OTHER HEALTH PROFESSIONAL LICENSED UNDER THIS
ARTICLE.

(c) Notwithstanding the provisions of subsection (a) of this section, unless the policy,
contract, or certificate expressly provides for reimbursement for any service which is within the
lawful scope of practice of a professional counselor OR PROFESSIONAL
COUNSELOR-MARRIAGE AND FAMILY THERAPIST certified under the Health Occupations
Article, the provisions of Title 17 of the Health Occupations Article governing the certification
and regulation of professional counselors may not be construed to entitle the insured or any
other person covered by the policy, contract, or certificate to reimbursement for any service
which is within the lawful scope of practice of a certified professional counselor OR
CERTIFIED PROFESSIONAL COUNSELOR-MARRIAGE AND FAMILY THERAPIST.
