259 Any part thereof to the same Joseph altho' afterwards to witt the same day and year afd at the County afd within the afd Jurisdiction he was thereto Requested he hath not paid nor the same Joseph for it any wise Contented but the Same hitherto to Do hath altogether Refused and Still doth Refuse to the damage of the Same Joseph of Sixteen pound Cash and thereof he Brings this Suite &c Dashiell P Quer Pledges &c J Doe R Roe And the afd William Freeman in his Own proper person Comes and defends the force and Injury when &c and says that he Cannot gainsay the action afd nor but that he did assume upon himselfe in manner and form as the afd Joseph above against him hath Complained Neither can he say but that the afd Joseph hath sustained damages by occasion of the Non performance of his promise and assumption afd to Eight pounds Cash and the same declaration in all the words before Expressly Confesseth &.c Therefore it is Considered that the afd Joseph Wyatt Recover against the afd William Freeman as well the Sum of Eight pounds Cash his damages afd by him in his declaration above supposed 231 as also Two hundred & thirty one pounds of tobacco for his Costs and Charges by him about his Suite in that part Expended to the Same Joseph by the Court here of his assent adjudged and the afd deft in Mercy &c Ordered by the Court that William Robertson pay unto George Stringer ^and John Bohannan^ sixty pounds of tobacco each being due unto them for their attendance two days Each as Evidence on behalfe of the said W.m Robertson against Jno and Henry Polke they having made oath to the same &c Ordered by the Court that Will.m Robertson pay unto Thomas Sasser and James Jaggers one hundred and twenty pounds of tob.o Each being due unto them for their attendance four days Each as Evidence on behalfe of ye said W.m Robertson against John & Henry Polke they having made Oath to the same &c Ordered by the Court that Rowland Bevens ^and Mary his wife^ pay unto Benj.a Tull, Sarah Taylor, Mary Fleming Mary Mayo Jun.r ^and^ Cornelius Dickenson Ninety pounds of tob.o Each ^Being Due unto them^ for their attandance three days Each as Evidence on behalfe of the said Rowland Bevins and Mary his wife against Littleton Townsend they having made Oath to the same &c Ordered by the Court that Littleton Townsend pay unto Andrew Collins Sixty pounds of tob.o being Due unto him for his attendance two days as Evidence on behalfe of the said Littleton Townsend against Rowland Bevins and Mary his wife He having made oath to ye same &c Ordered By the Court that Littleton Townsend pay unto Solomon Townsend and Francis Porter Ninety pounds of tob.o Each ^Being due unto them^ for their attendance three days Each as Evidence on behalfe of the said Littleton Townsend against Rowland Bevins and Mary his wife they having made oath to the Same &c |
