              B. M. Privateers that came up wth the Lifft immediatly uppon the

             Vol. 25. Governrs first answer tht the fellows were honest men the said

                  Privateer rid away post hast to Newcastle whereby I suppose

                  & doubt that before the Lifft can come time enough there the

                  Privatire will be gon away clear of Newcastle but their is noe

                  News there yet according to the Event shall give yr Excy parti

                  cular Information beging yr Excys pardon crave Leave to Re-

                [Depositions of John Hartekin and others.]

                   The Deposition of Jno Hartekin taken on oath before John

                  Farmer Esqr one of his Majtyes Justices of the Peace for the

                  Coty of Phyladeiphia this 29th 8br 1696.

                   Who on his Corporall Oath declareth & saith that being

                  enticed out of his Mr Joseph Woods service on board the

                  Brigantine Josiah Capt. Day comandr (a Pyrate or Privateer)

                  was upon his coming on board kindly entertan'd by them &

                  promised tht if his sd W should come on board them to fetch

                  him by a Justices Warrt from them as his Servt that he should

                  not have him for that sd Day was greater than a Justice of the

                  Peace because he had the Governrs Commission & that noe

                  Warrt but the Governrs Warrt should prevaile wth him & that

                  after hee the sd Hartekin had been on board amongst the sd

                  Privateers or Pyrates as one of their own Company two or

                  three days he heard some of sd Privateers complain that their

                  Brigantine was not near big enough to accomodate soe many

                  men as they had by carrying Provisions & lodge the men ans

                  wer was made by the Officers desiring them to be content for

                  tht if they would bee Patient in a fortnight or three weekes

                  time they would have a good ship under foot & burne the
