Attorney saith that one the fifteenth day of november
Annoq Domini 1671 the said John Avery Did by A
noate under his hand which by the plaintiffe is here
produced in Cort: oblidge himselfe at his owne proper
Charge to Possesse the said John Walker of three hundred
Acres of Land Lieing in A neck adjacent to Rehoveth
Bay at the horekill and in Consideracon for the same
the aforesaid John Avery Did then receive of the said
John Walker A horsse Bridle and Saddle to the vallue
of Two Thousand ffive hundred pounds of tobacco as
being full satisfaccon for the aforesaid three hundred
Acres of Land yet he the said John Avery Little regarding
to performe his oblidgement but fraudulently intending
to Deceive the said John Walker of the said Land the
plaintiffe saith he is Dampnified and hath Dammage
to the vallue of ffive Thousand pounds of Tobacco and
thereupon he bringeth his Sute ; / ; ~ ~ ~ ~
I John Avery doe binde my Selfe to finde
three hundred Acres of Land for John Warker
Clear of all Charge at the horekill as wittnes
my hand this 15th: day of november 1671
