1048 CONSTITUTIONAL CONVENTION OF MARYLAND [Nov. 20]

be made before recessing?

(There was no response.)

If not, the Chair recognizes Delegate
Powers.

DELEGATE POWERS: Mr. President,
in a very generous move, I move we recess
until 7:30 P.M.

THE PRESIDENT: Is there a second to
the motion?

(Whereupon, the motion was duly sec-
onded.)

THE PRESIDENT: All those in favor,
signify by saying Aye; contrary, No. The
Ayes have it. It is so ordered.

(Whereupon, at 5:52 P.M. the Conven-
tion was recessed, to reconvene at 7:30
P.M. on the same day.)

PRESIDING

THE PRESIDENT: The Sergeant-at-
Arms will clear the aisle's and close the
doors.

The Convention will please come to order.
Roll call.
(Whereupon, the roll was called.)

THE CHAIRMAN: Has every delegate
answered roll call?

The Clerk will record the roll call.

There being a quorum present, the Con-
vention is in session.

We still have before us section 5.14, open
to amendment. The pages will please dis-
tribute amendment BP.

DELEGATE CLAGETT: Mr. Chairman.

THE PRESIDENT: The Chair recog-
nizes Delegate Powers.

DELEGATE POWERS: Mr. President,
I move the Convention dissolve itself into
the Committee of the Whole to resume con-
sideration of the orders of the day.

THE PRESIDENT: Is there a second?

(Whereupon, the motion was seconded.)

THE PRESIDENT: All in favor, signify
by saying Aye; contrary, No. The Ayes
have it. It is so ordered.

(The mace was removed by the Sergeant-
at-Arms.)

(Whereupon, at 7:33 P.M., the Conven-
tion resolved itself into the Committee of
the Whole.)

THE CHAIRMAN: The Committee of
the Whole will come to order.

DELEGATE CLAGETT: Mr. Chairman.

THE CHAIRMAN: This will be Amend-
ment No. 26.

DELEGATE CLAGETT: Mr. Chairman.
THE CHAIRMAN: Delegate Clagett.

DELEGATE CLAGETT: I rise to a
point of personal privilege.

Earlier this afternoon we recognized
Mrs. F. DeSales Mudd as being present
here in the chamber. I overlooked the fact
that their daughter is also present and is
over the rostrum in the gallery.

THE CHAIRMAN: We are delighted to
have her here.

(Applause.)

THE CHAIRMAN: Amendment No. 26:
The Clerk will read the amendment.

READING CLERK: Amendment No. 26
to Committee Recommendation JB-1, by
Delegate Mitchell and Gill: On page 4 sec-
tion 5.14, Nomination and Appointment in
lines 45 and 46 strike out the words: "If
the governor fails to" and insert in lieu
thereof the words: "The governor shall";
and in lines 47 through 50 strike out be-
ginning with the words ", his power" in
line 47 down to and including the letters
"nees" in line 50.

THE CHAIRMAN: The amendment is
moved by Delegate Mitchell. Is there a sec-
ond?

(Whereupon, the amendment was sec-
