or displace the persons so appointed, and appoint other officers in
their stead;
and in case any appointments aforesaid should not be confirmed, and any
of the
officers aforesaid be displaced, and others not appointed in their stead,
within one
month after notice given by congress for that purpose, that appointments
may be
made by congress, agreeably to their resolve of the eighteenth of April,
seventeen
hundred and eighty-three; provided the person or persons that may be appointed
by congress be a resident of this state for at least three years preceding
such
appointment. |

IV. And be it
enacted, That the United States in congress assembled by authorised
to appoint convenient places within this state, at which the duties aforesaid
may be collected, and all officers appointed for the collection of the
duties
aforesaid, shall be amenable to, and removable by, congress; and the United
States in congress assembled shall have power and authority to inflict
such penalties
as they may judge necessary to prevent frauds, and to secure the punctual
payment of the duties aforesaid, and to enforce obedience to their ordinances
and
regulations respecting the duty of the officers to be appointed as aforesaid,
and
the faithful collection of the duties aforesaid; and all penalties inflicted
by congress
shall be recovered in the name of congress, and by the same speedy mode
as is established by law for the recovery of fines for the breach of any
of the
laws of this state; and the said United States in congress assembled, are
hereby
authorised and empowered to make such ordinances, regulations and arrangements,
as to them may seem proper or necessary, for the faithful and punctual
payment and collection of the said duties; provided that the said ordinances,
regulations and arrangements, shall not be incompatible with the constitution
or
laws of this state now in force. |

V. And be it
enacted, That the said duties are hereby granted to congress, for
the purpose of discharging the principal and interest of all debts contracted
on
the faith of the United States, for supporting the late war with Great-Britain,
agreeably to the resolution of congress of the sixteenth day of December
last,
and for no other purpose. |

VI. And be it
enacted, That the power before given to congress, to impose
and levy the said duties, shall remain and continue for the term of twenty-five
years after the same shall take effect, by similar laws having been passed
by all
the states in the federal union, and which congress shall accept as a substantial
compliance with that part of the resolution of the eighteenth of April,
which
recommends the duty and duties aforesaid, and no longer; and if the debt
due
by the United States during the late war, shall be paid and satisfied before
the
expiration of the said twenty-five years, then the power given by this
act to the
United States in congress assembled, to levy the duties aforesaid, shall
cease and
determine. |
Continuance. |
VII. And be
it enacted, That this act shall not be in force, before all and
every of the United States shall pass laws, vesting the United States in
congress
assembled with power to impose, levy and collect, the said duties, agreeable
to
the resolve of congress of the eighteenth day of April, seventeen hundred
and eighty-three,
for such time, and upon such terms, as the United States in congress
assembled shall accept as a substantial compliance with that part of the
resolutions
of the eighteenth of April, which recommends the duty and duties aforesaid;
and immediately upon such laws being passed, and such acceptance of the
United States in congress assembled, this act shall commence, and be in
force
for the term aforesaid. |

VIII. And be
it enacted, That the officer or officers appointed to collect the
duties aforesaid, in each and every district in this state, shall, and
he or they are
hereby directed, to deliver to the auditor-general of this state, annually,
a true
and exact account, on oath, of all the duties arising or accruing in virtue
of this
act, which account shall contain all monies received for said duties. |
