PRINCE GEORGE'S COUNTY. 3807

(S) Each of the Commissioners so elected shall, on or before the third
Monday in May of the year when he shall have been elected, qualify as
such Commissioner by taking an oath of office as prescribed by paragraph
J of Section 264 of this Article.

(T) In case any person so elected to the office of Commissioner shall
fail so to qualify or in case of any vacancy in the office of Commissioner
by death, resignation or otherwise, the remaining Commissioner or Com-
missioners shall fill such vacancy by appointment. Any person so ap-
pointed shall possess the qualifications stated in this Act, shall be a resi-
dent of the ward wherein such vacancy exists, and shall qualify by taking
the oath of office within three days after his said appointment.

(U) In making appointment to fill any such vacancy in the office of
Commissioner, the remaining qualified Commissioner (if there be but
one remaining qualified Commissioner) shall make such appointment by
entering in the minute books of said Commission the fact of his making
such appointment and the same day notifying the person so appointed of
his said appointment. And the remaining qualified Commissioner making
such appointment shall appoint as Commissioner such person who was a
candidate at the last election and who received the second greatest number
of votes in the ward wherein the vacancy exists. If the person so appointed
fails to qualify, then the remaining qualified Commission shall appoint as
such Commission such person who was a candidate at the last election
and who received the third greatest number of votes in the ward wherein
the vacancy exists, and so forth. And if there be no available candidates,
from such ward wherein vacancy exists, who were candidates at the last
election, then said remaining qualified Commissioners may appoint any
person from such ward wherein such vacancy exists provided the person
so appointed is eligible to the office of Commissioner under the provisions
of this Act. Any additional vacancy that may exist shall be filled by the
two qualified Commissioners by resolution, entered in the minute books
of said Commission, appointing as Commissioner such person who was a
candidate at the last election and who received the second greatest num-
ber of votes in the ward wherein the vacancy exists. If the person so
appointed fails to qualify, the two qualified Commissioners shall, in like
manner, appoint as such Commissioner such person who was a candidate
at the last election and who received the third greatest number of votes
in the ward wherein the vacancy exists, and so forth. And if there be no
available candidates, from such wards wherein such vacancy exists, who
were candidates at the last election, then said two qualified Commissioners
may appoint any person from such ward wherein such vacancy exists pro-
vided the person so appointed is eligible to the office of Commissioner under
the provisions of this Act.

275. (A) Immediately upon this charter's becoming effective as pro-
vided in Section 12* of this Act, Sam A. Oppliger, Alan Leighton and
V. A. Simmel shall constitute and be The Cottage City Commission until
