Mr. Dennis, from the Committee on Judicial Proceedings,
reported favorably,
House bill entitled an Act giving the sanction of the Gen-
eral Assembly of Maryland to a devise and bequest in the last
will and testament of Hugh Kennedy, of Washington Coun-
ty, deceased, to the Presbyterian Church of Hagerstown, in
said county,
With the following proposed amendments :
AMENDMENTS PROPOSED.
Amend the title by striking out all after the word "Mary-
land" in the first line, and including the word "also" in the
4th line.
And by striking out in the 5th and 6th lines of the title
the words "of the said property to the said Presbyterian
Church," and insert "of certain lots of ground in Hagers-
town, Maryland, to the trustees of the Presbyterian Church
in Hagerstown."
Strike out the preamble and Section 1.
2nd page, strike out the words "Section 2" and insert
"Section 1."
Add to. Section 2 the words "Provided, however, and the
acceptance of the sanction of the General Assembly of Mary-
land hereby given, or the exercise of any power given by this
Act, or the making of any such deeds, or the acceptance of
any such deed shall be and bs deemed a covenant by the trus-
tees of the Presbyterian Church in Hagerstown, with the
heirs of the said Hugh Kennedy or John Kennedy, and each,
of them, that the one-fourth part of the purchase money aris-
ing from any sale of said land, or any part thereof, by the
trustees of the Presbyterian Church in Hagerstown, shall be
appropriated to the use of and to the keeping in order perpet-
ually the cemetery or graveyard now on said land, and the
eaid one-fourth part of the purchase money shall be held by
the purchaser or purchasers, or such person or body corporate
as he or they may by deed appoint in trust for said purpose,
the principal to be invested safely and the interest only to be
used."

Said bill, as amended, was then read the second time.
