Interest thereon as by the Said Writing more fully is Manifest and Appears And the Said James in fact
Says that the Said Ann hath not as yet paid unto the Said James the Sum of Seventy five pounds Curt Money of
Maryland afd. And the Sum of two pounds Seven Shillings and Six pence for the Interest thereon due unto the
Twenty Second day of March in the Year of our Lord One thousand Seven hundred and Sixty One which he to
have Said Sums of Money the Said Ann Ought to have paid or Caused to have been paid to the Said James
According to the form and Effect of the Writing afd. And So thereof Indebted Said James Says that the Said Ann
Altho often Required hath not performed her Covenant afd. with the Said James in this Respect as afd. made but
hath broken it and hath hitherto Altogether denyed and Yet doth deny to perform it to him whereby the Said
James Says that he is Prejudiced and hath Damage to the Value of One hundred pounds Curt Money of
Maryland And thereof he brings Suit and So forth                                       Pledges &c. J: Doe & R: Roe
      And the afd. Ann Records bye her Attorney afd. Comes and Defends the force and Injury when &c And prays
Leave thereof to Imparle here untill next Court to be held at Princes Ann Town the third Tuesday of November
then next following and She hath it and the Same day is Given to the afd. James here also &c
           Att which day here Came as well the afd. James Hitch as the afd. Ann Records by their Attorneys
afd. And hereupon the Said Ann prays further Leave thereof to Imparle here untill next Court to be held at
Princes Ann Town the third Tuesday of March then next following and She hath it and the Same day is
Given to the afd. Ann here also &c.
        Att which day here Came as well the afd. James Hitch as the afd. Ann Records by their Attorneys
afd. And hereupon the Said Ann as before defends the force and Injury when &c. And Saith that She Cannot
deny the Action afd. of the afd. James Hitch nor but that She did break her Covenant with the afd. James in
Manner and form as the afd. James Above Against her hath Declared and as to the Damage of the Same James
by her by Occasion of the Breach of the Covenant afd. in that part Sustained the Same Ann Saith and Acknowledgeth
that the afd. James hath Sustained Damages by Occasion of her breach of Covenant afd. beyond his Costs and
Charges in that part Apposed to One hundred pounds Curt Money of Maryland in manner and form as the afd.
James Above Against her hath Declared &c. Therefore it is Considered that the afd. James Hitch Recover
Against the afd. Ann Records his Damages afd. by the afd. Ann in form afd. Acknowledged as also
286                                Pounds of Tobacco for his Costs and Charges afd. to the Said James at his Request by the Court
now here of the Assent of the parties afd. Adjudged which Certain Damages in the whole Amount to One hundred
pounds Curt Money and                                                    Pounds of Tobacco and the afd. Ann in Mercy &c

His Lordship
@    Somerset to wit The Jurors for his Lordship the Right Honrble the Lord Propry that now is for the body of
James Collings    Somerset County upon their Oath present that James Collings Late of Stepney Parish in the County afd.
Planter on the Eighth day of February in the Year of our Lord One thousand Seven hundred and Sixty Two with force &
Arms at the Parish afd. in the County afd. in and upon a Certain John Jenner in the peace of God and the Said Lord
Propry then and there being an Assault did Make and him the Said John then and there did beat wound and Ill
treat so that of his Life it was Much dispaired and other harms to him the Said John then and there did to
the Great damage of the Said John and Against the peace of his Lordship the Right Honrble the Lord
Propry that now is his Good Rule and Government and So forth       George Hayward Pro. Doms. Propry
on the Back of the foregoing Indictment it was thus Endorsed Vizt         No bill    Levin Dashiell foreman
