32 VOTES AND PROCEEDINGS, NOVEMBER SESSION, 1808.

ed and appropriated as other fines are by this act, and the act to which this is a supplement. And be it enacted,
That it shall be the duty of the brigade inspector of each brigade, to attend on the clays appointed by the bri-
gadier or commanding officer of his brigade, for the meeting, training and instructing, of officers of the different
regiments and extra battalions in his brigade, and to train and discipline the same under and agreeably to the
directions of the brigadier or commanding officer of the brigade; that for every and each meeting on which he
shall neglect to attend, he shall be fined twenty dollars, not having a reasonable excuse, to be adjudged of by a
court-martial. And be it enacted, That each and every brigade inspector, for his services in training and in-
structing the regimental officers of the brigade, shall be entitled to, and allowed a salary of, ——— dollars, in
addition to his present salary, provided he obtains a certificate from his brigadier or commanding officer of his
having faithfully discharged his duty, which salary shall be paid in the manner directed by the act to which this
is a supplement, " the question was put, That the house assent to the two first clauses thereof? The yes and
says being required, appeared as follow: "

On motion, the third clause of said amendment was withdrawn.

On motion, the question was then put. That the following be inserted after said amendment? to wit: "And
be it enacted. That if any noncommissioned officer or private who has a musket or gun, shall appear in the
ranks or at any time during exercise without it, he shall be fined, at the discretion of a company court-martial,
in a sum not exceeding one dollar nor less than twenty-five cents, unless he can make a reasonable excuse to
the commanding officer of the company, battalion, extra battalion or regiment, as the case may be. " The yeas
and nays being required, appeared as follow:

On motion, the question was then put, That the following be inserted after the last amendment? viz. " And
be it enacted, That it shall and may be lawful for any person not enrolled in any uniformed company, and sub-
ject to militia duty, to join any uniform militia company willing to receive him as a member thereof, although
the said company may be attached to a brigade different from the one in which he is or may be enrolled, any
thing in the act to which this is a supplement to the contrary notwithstanding. " The yea and nays being re-
quired, appeared as follow:

battalion not in uniform, shall associate for the purpose of forming a uniform militia company, it shall be the
duty of the governor and council to commission such persons as shall be recommended by a majority of the com-
