LAWS OF MARYLAND.

SEC. 2. And be it enacted, That the said company shall
have full power and authority to make and pass all such
rules and bye-laws as may be necessary to regulate and
govern, first the manner in which boats, rafts or other thing
navigating the Canal shall approach and pass through the
locks, and what kind of boats, rafts or other thing naviga-
ting said canal, shall have preference in passing through
said locks; secondly, the manner in which boats, rafts,
crafts and other things shall pass each other in said canal,
and when and what kind of lights, boats or other things
shall carry while navigating said canal in the night, and to
prescribe the rate at which all boats or other things naviga-
ting said canal shall travel; thirdly, to prevent the canal
from being obstructed by boats or other things being an-
chored or made fast to either side of said canal or set adrift
in said canal, and to prescribe when and which side of the
canal boats, rafts or other things shall be anchored or made
fast, and all other needful rules to prevent the obstructions
of said canal, or any of the locks thereof, and to regulate
in any and every way the navigation of said canal; fourthly,
to make all needful rules and bye-laws to detect and pre-
vent frauds in the payment of tolls, and to enforce compli-
ance with any rules or bye-laws made to prevent or detect
frauds in payment of tolls, and as a penally for the viola-
tion of any such rules or by laws, that the person or per-
sons so violating, shall pay additional toll, not exceeding
three times the amount of toll usually charged.

SEC. 8. And be it enacted, That if any person or per-
sons navigating said canal shall take or destroy any fences,
fence, rails, wood, timber, grain, grass or any other thing
belonging to any person or persons having the occupancy
of any lands along the line of the canal, every such person
so offending, shall pay to the owner the full value of the
property destroyed, and shall also pay a penalty of twenty
dollars for each offence, to be collected as hereinafter pre-
scribed, any person or persons turning his or their horse
or horses, mule or milles, on any of the lands in the, vicinity
of said canal, without the consent of the owner or occu-
pant of said land, shall he liable to the same, punishment
and penalties inflicted by this section on those who take
fences, rails, &c.

SEC. 4. And be it enacted, That if any person or per-
sons shall carelessly or neglectfully break or injure any lock,
fate, wicket, embankment, wall or other work appertain-
ing to said canal, such person or persons shall pay a sum
equal to the damage sustained by said company by such
injury, to be recovered by said company, if under fifty
dollars, before a single justice of the peace as small debts
