the county court of the county where the injury was com-
mitted.

No person to
obstruct out-
let lock, &c.

SEC. 5. And be it enacted, That no person or persons
shall anchor or place any vessel or other thing so near the
outlet locks as to obstruct or impede the use of such outlet
locks, nor shall any person build or erect on or against the
tow-path or embankment of said company, any house, shed,
wharf or other fixtures, and any person or persons offend-
ing against the provisions of this section, shall pay to the
company the sum of twenty dollars for each offence, to be
recovered by said company in all respects as small debts
are recovered.

SEC. 6. And be it enacted. That the said company by
its officers, agents and servants, may remove any of the
obstructions or fixtures prohibited by this act, and the said
company may prescribe such penalties for the violation of
its bye-law as may be necessary to inforce a compliance

therewith; provided, no penalty for a single offence shall ex-
ceed twenty dollars, except offences in regard to tolls
which is hereinbefore provided.

SEC. 7. And be it enacted, That if any person who
has violated any of the provisions of this act, or any of the
bye-laws made in pursuance thereof shall be about to leave
this State, it shall be lawful for the said company by its offi-
cers, agents or servants, to arrest such person, carrying
him before a justice of the peace, whose duty it shall be to
commit such person to answer the offence alledged against
him, unless such person give sufficient bail to appear and
answer as the justice shall direct, and the said company as
a further means to prevent persons from absconding who
have violated any of the provisions of this act, may by its
officers, agents and servants, seize the boat, raft or other
craft of such person, and detain the same till the person so
offending shall have answered, in the due course of law for
such offence.

SEC. 8. And be it enacted, That all fines and penalties
enforced by this act, the collections and enforcements of
which is not herein otherwise provided for, shall be recov-
ered in the name of the company or the party aggrieved,
before a single justice of the peace as small debts are now
recovered.

SEC. 9. And be it enacted, That nothing in this act con-
tained, shall be so construed as to interfere with the rights
heretofore granted for building an outlet lock at or near
Bell's Kerry.
