TITLE OF THE CODE, SAID NEW SECTIONS TO FOLLOW
IMMEDIATELY AFTER SECTIONS 663A (E) AND 663A (V)
THEREOF, RESPECTIVELY, GENERALLY AMENDING THE
LAWS IN REFERENCE TO THE TAKING OF SOFT SHELL
CLAMS IN ANNE ARUNDEL COUNTY.

Section 1. Be it enacted by the General Assembly of Maryland,
That Sections 663A (v) and 663B (a) of Article 66C of the Anno-
tated Code of Maryland (1956 Supplement), title "Natural Re-
sources", sub-title "Oysters and Clams", be and they are hereby
repealed and re-enacted, with amendments, to read as follows: AND
THAT NEW SECTIONS 663A (E-l) AND 663A (W) RESPEC-
TIVELY, BE AND THEY ARE HEREBY ADDED TO SAID
ARTICLE AND SUB-TITLE OF THE CODE, TO FOLLOW IMME-
DIATELY AFTER SECTIONS 663A (E) AND 663A (V), RE-
SPECTIVELY, AND ALL TO READ AS FOLLOWS:

663A (E-l) 1. IN ANNE ARUNDEL COUNTY ALL HY-
DRAULIC OR MECHANICAL CLAM DREDGES AND BOATS
LICENSED AND OPERATING UNDER THE PROVISIONS OF
SECTION 663B SHALL HAVE PROPERLY INSTALLED AN
ADEQUATE MUFFLER ON ALL MOTORS AND ENGINES
USED IN THE OPERATION OF SAID BOAT OR HYDRAULIC
OR MECHANICAL CLAM DREDGE. THE WATER JET PIPES
AT EACH END OF THE MANIFOLD SHALL BE SET PARALLEL
TO THE MEDIAN VERTICAL LONGITUDINAL PLANE OF
THE DREDGE. A PROPELLER GUARD SHALL BE USED AS
MAY BE REQUIRED BY THE COMMISSION OF TIDEWATER
FISHERIES. THE COMMISSION OF TIDEWATER FISHERIES
MAY REQUIRE SUCH MODIFICATIONS TO THE HYDRAULIC
CLAM DREDGE AND/OR LICENSED DREDGE BOATS AND
RIGS AS MAY BE DEMONSTRATED TO BE IN THE PUBLIC
INTEREST THROUGH RESEARCH OF THE DEPARTMENT
OF RESEARCH AND EDUCATION AND RECOMMENDED FOR
ADOPTION TO THE LATTER AGENCY. THE LICENSE NUM-
BER OF THE BOAT OR RIG SHALL APPEAR ON BOTH SIDES
OF THE BOAT OR RIG IN CLEAR LETTERS, NOT LESS THAN
EIGHT (8) INCHES HIGH. ANY PERSON WHO OPERATES
SUCH BOATS OR RIGS WITHOUT THE ABOVE SPECIFIED
REQUIREMENTS SHALL BE DEEMED GUILTY OF A MIS-
DEMEANOR AND UPON CONVICTION SHALL BE FINED NOT
LESS THAN FIFTY DOLLARS ($50.00) NOR MORE THAN
FIVE HUNDRED DOLLARS ($500.00).

663A. Soft Shell Clams.

(v) Nothing in this section shall be construed to permit any
hydraulic, mechanical or other kind of power dredge or rig to be
used for the taking of clams within [five miles] one hundred yards
of any oyster bar in the waters of Anne Arundel County.

(W) 1. STATIONS FOR BUYING AND TAXING SOFT
SHELL CLAMS SHALL BE DESIGNATED IN ANNE ARUNDEL
COUNTY BY THE COMMISSION OF TIDEWATER FISHERIES.

2. IN ANNE ARUNDEL COUNTY THE COMMISSION OF
TIDEWATER FISHERIES MAY REQUIRE REPORTS OF CLAM-
MING OPERATIONS FROM LICENSEES WHICH SHALL BE
KEPT AS CONFIDENTIAL INFORMATION.
