3.     IN ANNE ARUNDEL COUNTY THE OPENING AND
CLOSING OF WATERS IN WHICH SOFT SHELL CLAMS MAY
BE TAKEN FROM TIME TO TIME, SHALL BE DETERMINED
BY THE COMMISSION OF TIDEWATER FISHERIES, WHICH
COMMISSION SHALL ACT WITH THE ADVICE OF THE
CHESAPEAKE BIOLOGICAL LABORATORY. THE SAID COM-
MISSION SHALL PUBLISH AND MAKE AVAILABLE TO THE
LICENSED CLAM DIGGERS, AND TO OTHER INTERESTED
PERSONS, THE REGULATIONS PERTAINING TO THEIR
OPERATION IN LOCAL WATERS.

4.    IN ANNE ARUNDEL COUNTY THE COMMISSION OF
TIDEWATER FISHERIES SHALL COLLECT A TAX OF NOT
LESS THAN TEN CENTS (10¢) AND NOT MORE THAN
TWENTY-FIVE CENTS (25¢) PER BUSHEL OF SOFT SHELL
CLAMS AND CREDITED TO THE "CLAM FUND".

5.    PRIOR TO THE OPENING OR CLOSING OF ANY ANNE
ARUNDEL COUNTY TRIBUTARY AND SHOAL WATERS, THE
CHESAPEAKE BIOLOGICAL LABORATORY SHALL FROM
TIME TO TIME CONDUCT A SURVEY AND RECOMMEND
TO THE COMMISSION OF TIDEWATER FISHERIES WHICH
OF SAID WATERS MAY BE OPENED OR CLOSED.

663B.

(a) [Anne Arundel,] Dorchester and Wicomico Counties. It shall
be unlawful for any person, firm or corporation to take, catch or
dredge soft shell clams (mya arenaria) from any county waters of
[Anne Arundel,] Dorchester and Wicomico Counties by the use of
any hydraulic or mechanical dredges. Any such person, firm or
corporation so doing shall, upon conviction thereof before any justice
of the peace, be fined $500.00 and the costs.

(B)   SOMERSET, KENT AND ST. MARY'S COUNTIES—IT
SHALL BE UNLAWFUL FOR ANY PERSON, FIRM OR COR-
PORATION TO TAKE, CATCH OR DREDGE SOFT SHELL
CLAMS (MYA ARENARIA) FROM ANY COUNTY WATERS
OF SOMERSET, KENT AND ST. MARY'S COUNTIES BY THE
USE OF ANY HYDRAULIC OR MECHANICAL DREDGES. ANY
SUCH PERSON, FIRM OR CORPORATION SO DOING SHALL,
UPON CONVICTION THEREOF BEFORE ANY JUSTICE OF
THE PEACE, BE FINED $500.00 AND COSTS.

(C)   IN ANNE ARUNDEL COUNTY THE PERIOD OF RESI-
DENCY IN SAID COUNTY AS PROVIDED IN SECTION 663A
(A) AND (C) SHALL BE TWO (2) YEARS BUT NOT NECES-
SARILY IMMEDIATELY PRIOR TO THE APPLICATION OR
ISSUANCE OF A LICENSE AND THE APPLICANT SHALL
ALSO AT THE SAME TIME HAVE HAD A MARYLAND
OYSTER TONGING LICENSE FOR ANNE ARUNDEL COUNTY
PRIOR TO SAID APPLICATION TIME FOR A LICENSE HERE-
UNDER.

THE FINES AND PENALTIES FOR VIOLATION OF SEC-
TION 663A AND FEES HEREIN PROVIDED AS IT APPLIES
TO THE WATERS OF ANNE ARUNDEL COUNTY SHALL BE
PAID OVER TO THE CLAM FUND FOR THE RESEARCH
