under a new sub-title to be known as "State Roads Commission Right
of Way Revolving Fund", said new sections to be known as Sections
162D (1-A) and, 162D (1-B) AND 162D (1-C), and to follow imme-
diately after Section 162D (1), and to read as follows:

162D (1-A). The State Roads Commission is hereby authorized to
reserve and set aside annually for the next five years from the Con-
struction Fund monies available under the Twelve Year Highway
Construction and Reconstruction Program a sum not to exceed Two
Million ($2,000,000) Dollars in each of said five years for the pur-
pose of purchasing rights of way, in addition to the rights of way
scheduled for acquisition in the document entitled "Road Construction
and Reconstruction in the proposed Twelve Year Program" for proj-
ects scheduled for future construction or reconstruction in the said
above referred to document, and projects scheduled to be completed
under the Federal-Aid Highway Act of 1956. This fund will be known
as the "State Roads Commission Right of Way Revolving Fund" and
shall be specially designated by the Comptroller of the State Roads
Commission for said purpose on the books of the Commission.

162D. (1-B). The Commission is authorized to temporarily reduce,
to the extent necessary, the expenditure of construction funds and
eliminate from its construction program such project or projects as
may be necessary to provide the said Two Million ($2,000,000) Dollars
annually. When the contracts for which the rights of way were pur-
chased are awarded for construction, then the Comptroller of the
State Roads Commission shall charge the right of way cost against
said contracts and cause a credit to be made to the State Roads Com-
mission Construction Fund, from which said amounts were origin-
ally taken, to the end that when all of the contracts for which funds
from this account were used are awarded, the said construction fund
will be reimbursed to the full extent, and the projects temporarily
eliminated from the program restored thereto.

162D. (1-C). ANY LAND PURCHASED OR OTHERWISE AC-
QUIRED BY THE STATE ROADS COMMISSION UNDER THIS
ACT WHICH IS NOT THEREAFTER USED FOR A ROAD OR
ROADS MAY BE USED BY THE SELLER OR TRANSFEROR
AS A RIGHT OF WAY IN COMMON WITH THE STATE ROADS
COMMISSION UNTIL SUCH TIME AS THE STATE ROADS COM-
MISSION ACTUALLY INITIATES CONSTRUCTION OF A ROAD
OR ROADS UPON SUCH LAND. NOTHING IN THIS ACT SHALL
PROHIBIT THE STATE ROADS COMMISSION FROM REMOV-
ING ANY BUILDING OR STRUCTURE AT ITS DISCRETION;
PROVIDED, THE OWNER OR TRANSFEROR SHALL NOT CON-
STRUCT ANY BUILDING OR OTHER STRUCTURE THEREON
OR USE THE PROPERTY IN SUCH WAY THAT THE STATE
ROADS COMMISSION WILL HAVE TO PAY ADDITIONAL
MONEY OR DAMAGES THEREFOR. IF AND WHEN THE
STATE ROADS COMMISSION ABANDONS THEIR ROAD OR
RIGHT OF WAY THE SELLER, ASSIGNOR OR HEIR SHALL
HAVE THE PRIOR RIGHT TO PURCHASE THE PROPERTY
AT THE ORIGINAL OR BOOK VALUE.

Sec. 2. And be it further enacted, That this Act is declared to be
an emergency law and necessary for the immediate preservation
of the public health and safety, and having been passed by a yea and
