SPECIAL SESSION OF MARCH 11, 1964
CHAPTER 12—Montgomery County

I, Lloyd L. Simpkins, Secretary of State of the State of
Maryland, pursuant to the direction contained in Section 172 (c)
of Article 33 of the Annotated Code of Maryland, (1957 Edition),
Do Hereby Certify, that at the General Election held in the State of
Maryland on November 3, 1964, an Act known as Chapter 12 of the
Acts of the Special Session of March 11, 1964, was submitted to the
voters of Montgomery County, under the provisions of Chapter 12 of
the Acts of the Special Session of March 11, 1964, said Act being as
follows:

AN ACT to repeal and re-enact, with amendments, Section 19
(h) of Article 2B of the Annotated Code of Maryland (1957
Edition and 1963 Supplement), title "Alcoholic Beverages,"
subtitle "Beer, Wine and Liquor Licenses," providing that said
Section shall be null and void after April 30, 1965; and to add
new Section 19 (h-1) to Article 2B of the said Code to the
aforesaid title and subtitle, to follow immediately after said
Section 19 (h), to provide for the issuance of Class B (on sale)
Hotels and Restaurants, Beer, Wine and Liquor Licenses in
Montgomery County to restaurant owners located in third,
fourth, seventh, eighth, ninth, tenth or thirteenth election
districts, except Poolesville, Kensington and Takoma Park
subject to the requirement that gross receipts from food sales
shall be more than twice the gross receipts from the sale of
alcoholic beverages during a twelve month license period and
to provide that the license holder shall sell alcoholic beverages
for consumption on the premises only, that no alcoholic
beverages shall be served at any bar, counter, cocktail lounge
or other room but only in the dining rooms which must have
at least 1,000 square feet of dining area, that no signs visible
from the exterior advertising the sale of alcoholic beverages
shall be permitted, and generally to provide for the terms and
conditions under which said licenses shall be issued and fur-
ther to provide for a referendum on this Act.

and I DO certify that at said election 70,300 votes were cast
in favor of adoption of Chapter 12 of the Acts of the Special Session
of March 11,1964 and 68,208 votes were cast against adoption of said
Chapter 12 of the Acts of the Special Session of March 11, 1964, the
said Act has therefore been ratified by a majority of the qualified
voters of Montgomery County.

In Testimony Whereof, I have hereunto subscribed my
name and affixed my official seal at the City of
Annapolis, this 1st day of December, 1964.
