ation of the fformer Article being attended with such Circum- Lib. C. B. stances as are Before alledged in both which Articles of ffees I sue for relief to your Excellency & this honrble Board What I have further to Offer to your Excellency and this honrble Board is of a different Nature; and therefore crave the p. 61 liberty to your Excellency that by a certain Clause in the afore recited Act of Assembly, for ascertaining Officers ffees, Your Excellency and this honrble Board impower'd to rate and value the Services of the Officers, not in the said Act rated and valued in these words & is further provided that if any ffees for any matter or thing whatsoever hereafter to be done belonging to the Office aforesaid by the Governour and Coun cill so allowed and adjudged and not in this Act mention'd Limitted allowed & Adjudged, it shall be Lawfull for such Officer to have such ffee or ffees as the Said Governour & Councill for the time being shall adjudge and allow off, & no more, And now may it please your Excellency for as much as Some Service wch the Clerke of the Provinciall Court is Obliged to do, are not by the Said Act of Assembly rated & valued I humbly Pray your Excellency & this honrble Board that the Said Clk of the Provinciall Court may be allowed to Charge, what your Excellency & this honrble Board in your great Wisdom shall think he Deserves for the Services ffol- lowing viz. Imprs for every Oath taken in Court for which the Cryer of the Same Court hath allowed him 12 l of Tobo & the Clerke of every County Court Six pounds of Tobacco. 2dly ffor all probatts of Accts taken in open Court for which the Clerk of every County Court are allow'd 8 pounds of Tobacco. The Premises above being duly considered I hope your p. 62 Excellency & this honrble Board will relieve me in what is above Suggested & Your Petr as in Duty Bound shall ever Pray. The above Petition being read & considered,
Ordered that the Secretary take lbs Tobo For every Oath taken in Court - - 8 For Probate of Accounts in Open Court - 8 For every Execution and returne allow'd- 28 For every matter not exceeding half a Side the Law having given no ffee thereforeallowed 8 to take until the Next Assembly - ________
Then was read the Report of the Rt honrble the Lords of Trade &c and her Majestys Order in Councill that the Law for the Suspending the Prosecution of Romish Priests should
