the purpose of procuring dirt for the use of the streets and side-
walks ; and after having given at least ten days' notice in writing
to all persons interested, they shall appoint a committee of three

discreet persons, not residents of said town, who shall, under a
penalty of ten dollars, proceed to assess and value on oath what
damages may have been sustained by reason of such widening,

opening or straightening of said streets, or of the condemnation
of said lot, and shall make return thereof to said commissioners,
under their hands and seals; and any person whatsoever who may
think himself aggrieved by the decision of the commissioners may,
by petition, appeal to the next circuit court for Dorchester county;
and the judges thereof are authorized to revise and correct any
judgment or decision made by said commissioners; and the
appellant shall be entitled to a trial by jury, provided he shall

demand the same.

310. If at any election for a commissioner it shall appear by
the record of the judges thereof, that any two or more persons,

voted for as commissioners, have received the same number of
votes, so that there is no choice for an entire board, but a vacancy
still existing, the commissioners in office shall proclaim a new
election by giving five days' notice thereof.

311. If the commissioners of said town shall fail at any time
to hold their regular quarterly meetings, or their annual election
as herein specified, such failure on their part shall not work a
forfeiture of this charter, but such meeting or annual election
shall be held as soon thereafter as possible.

312. They shall cause the streets and sidewalks within the
limits of the town proper to be kept in good order; and the
bailiff shall superintend the same, and within the limits of the
town have all the powers of a supervisor of the county roads.
