CHAP. 47.

Justice of the
Peace shall
appoint judges

SEC. 3. And be it enacted, That any justice of the
peace of Carroll county, when called on, shall appoint by
writing under his hand and seal, three judges to hold the
first election, who shall keep the polls open from one till
five o'clock P. M., on the day aforesaid, and shall certify
under their hands and seals that the election was fairly con-
ducted and in accordance with the provisions of this act,
declaring the persons having the highest number of votes
to be duly elected, said papers shall be entered on the
records of the corporation.

Future electi-
ons by corpo-
ration.

Sec. 4. And be it enacted, That all future elections shall
be conducted as the corporation by their by-laws may
direct defining more fully the qualifications of officers and
voters for said corporation.

Burgess to
preside.

Sec. 5. And he it enacted, That the burgess shall pre-
side at all meetings of the municipality, and have the privi-
ledge of the casting vote only, in his absence, the oldest
commissioner present shall preside, subject to the same
restrictions.

To meet once
in every three
months.

Sec. 6. And be it enacted, That the burgess and com-
missioners may meet together from lime to time as often as the
business of the town may require, and not less than once in
three months, and if a vacancy occurs by any means, in the
office of burgess or commissioners, the same shall be filled
by a new election of which at least ten days notice shall
be given, at which election the same qualification of voters
will be required as at the annual election

Appoint clerk,

Sec 7. And be it enacted, That the burgess and com-
missioners shall have power to appoint a clerk, and assign
his duties, and allow him such compensation for his services
as they may think right, (any commissioner except the
oldest may be such clerk, ) and that all ordinances passed by
said commissioners and signed by the burgess, and all other
papers that they may direct, shall by their clerk be entered
in a book of records to be kept by him for that purpose,
and shall be open at all time, for inspection of persons
interested, and copies of all ordinances shall be put up in
the most public places in said town, that the same may be
generally made known.

Fines—how
collected.

Sec. 8. And be it enacted, That all fines and forfeitures
under the ordinances of said corporation and the laws of
this State, within its limits, shall he recoverable before the
burgess aforesaid, as small debts arc recoverable out of
court, by a single justice of the peace, or the same may
be recovered before a justice of the peace of the county,
in the absence of the burgess, or at his request, for the use

Proviso,

of the corporation, provided, that no fine or forfeiture under
any ordinance of said corporation shall exceed the sum of
twenty dollars.
