Cecil county, to give and execute his bond as sheriff as aforesaid,
any time before the first day of February next, and the justices of
the orphans' court of said county, or any two of them, either in or
out of court, are hereby required and commanded to take said
bond accordingly, and which shall be deemed and considered as va-
lid and effectual as if the same had been done by the time limited by
law, any law to the contrary notwithstanding.

8. And be it enacted, That all acts which the said Francis Gilles-
pie as sheriff aforesaid, may do or shall have done- in pursuance of
the aforesaid warrant of election, shall be to all intents and purposes
as valid and effectual as if he had executed his bond within the pe-
riod prescribed by law, or as if this act had been passed before his
proceeding in the execution of the said warrant.

CHAPTER 45.
An act to extend and open Record Street to intersect Second Street, in Frede-
rick Town.
Sec. 1. Be it enacted by the General Assembly of Maryland, That
John M'Pherson, senr. John Hanshew and William Tyler, be, and
they are hereby appointed commissioners,and they or any two of them,
are hereby empowered to open and extend Record street in Frede-
rick Town, from Council street to Second street, continuing the
course of the said Record street, until it intersects the said Second
street; and the said commissioners are hereby required to return a
plot ascertaining the limits and extent of the said street when so ex-
tended and opened, to the register of the corporation of Frederick,
who shall receive and file the same as part of the plot of Frederick
|
Restriction.

2. And be it enacted, That the street aforesaid, shall not be extend-
ed or opened through the property of any individual without his con-
sent first had and obtained, nor without the consent of the trustees
of the academy, on their being satisfied that no material injury will
be sustained to the lot on which the academy is built; Provided any
expenses that may accrue in extending and opening the said Record
street, be defrayed by those who may voluntarily subscribe for the
same.

CHAPTER 46.
An act to authorise John F. Gray to receive one sixth for toll at his mill when
the same shall be built in Charles county.
Whereas,it is represented to this general assembly, by a petition
from sundry citizens of Charles county, that it would be a great con-
venience and advantage to the petitioners, neighbors of John F.
Gray of said county, if a mill was erected upon a stream running
through the land of the said Gray; And whereas the said John F.
Gray cannot incur the expense of building a mill for the present rate
of toll established by law; and pray the legislature to pass a law au-
thorising the said John F. Gray to receive one sixth for toll at the
said mill when built, and the said prayer appearing reasonable—

Be it enacted by the General Assembly of Maryland, That it shall
and may be lawfull for the said John F. Gray, to ask, demand and
receive any toll for grinding any grain except wheat, at the mill to be
erected by the said John F. Gray, Provided the same shall not ex-
ceed one sixth part thereof, any law, usage or custom to the con-
trary notwithstanding.
