CHAP, VIII.
An ACT to authorife and empower the affociate juftices of Caro-
line county court to call a court before the time to which the
fame ftands adjourned.

WHEREAS the fheriff of Caroline county lately elected, comrmffion-
ed and qualified, is dead, and the perfon fecond upon the return to
the governor and council has refufed to act, and the governor, with
the confent and advice of the council, hath appointed and commiffioned Dekar
Thompfon fheriff of the faid county, to act for the remaining part of the three
years for which the aforefaid fheriffs elect were to have acted; therefore,

II. Be it enacted, by the General Affembly of Maryland, That the affociate
juftices of Caroline county court be and they are hereby authorifed and empower-
ed to call a court before the day to which the fame ftands adjourned, and when
fo called, to proceed to qualify the faid Dekar Thompfon as fheriff of Caroline
county aforefaid, by adminiftering to him the feveral oaths, and taking his bond
with fecurity, agreeably to the conftitution and laws of this ftate, and the pro-
ceedings of the faid juftices fhall be valid to all intents and purpofes, any law to
the contrary notwithstanding.

CHAP. IX.
An ACT for the eftablifhment of a market for the fale of live
ftock at Weftminfter-town, in Frederick county.

WHEREAS great convenience and advantage would arife to the citizens
of this state if a public market was eftablifhed, under proper regula-
tions, in or near to Weftminfter-town, for vending live ftock of dif-
ferent kinds; and this general affembly being defirous of promoting fuch an efta-
bliftiment,

Preamble.

II. Be it enacted, by the General Affembly of Maryland, That Jofhua Gift,
Stephen Winchefter, David Shriver, fenior, David Fifher, Jacob Sherman, John
Yingling, Ludwick Wampler and David Shriver, junior, or a majority of them,
be and they are hereby appointed commiffioners, with full power and authority
in them vefted to purchafe, in fee-fimple or for a term of years, a quantity of
land, not exceeding three acres, in or near to Weftminfter-town, and the fame
land to lay out into fmall and convenient lots, with proper enclofures and ftalls
for the reception of cattle, and to hold a market thereon as hereafter provided,
which faid land, when obtained, fhall be held by the commiffioners aforefaid, and
their fucceffors, in truft, for the purpofes in this act contained.

III. And be it enacted, That from and after the firft day of March next, one
day in every week, to wit, Thurfday, fhall be held as a market-day at the faid
market-fpace, and the commiffioners aforefaid may moreover eftablim as market-
days two or more days in each year, for holding a general market in the faid
market-fpace, and all horfes, fheep, hogs, and live cattle of every kind, that
may be brought to the faid town, and that may be for fale, on any of the faid
market-days, lhall be carried to the faid market-fpace to be fold.

IV. And be it enacted, That no perfon fhall buy or fell, or caufe to be bought
or fold, from or to any perfon or perfons within three miles of the faid town of
Weftminfter, any horfe, live cattle of any kind, fheep or hogs, driving to mar-
ket upon market-days, at any place whatfoever but at or in the faid market-fpace,
under the penalty of three dollars for every fuch offence, to be recovered from
fuch purchafer or feller, feverally, for the ufe and in the name of the informer,
before a fingle magiftrate, as fhall debts are by law direded to be recovered.

V. And be it enacted, That on the death, removal from Frederick county, or
refignation, of any of the faid commiffioners, the major part of the remaining
commiffioners fhall appoint another to fervc in the ftead of fuch commiffioner fo

dying, removing or refigning.
