AN ACT to repeal and re-enact, with amendments, Section 51 (d)
of Chapter 780 of the Acts of the General Assembly of 1959, said
act having enacted the sub-title "Park and Planning Commission",
and added said sub-title to the Montgomery County Code (1955
Edition, being Article 16 of the Code of Public Local Laws of
Maryland) and added said sub-title also to the Code of Public
Local Laws of Prince George's County (1953 Edition, being Article
17 of the Code of Public Local Laws of Maryland), said Section
51 (d) being in the sub-heading "Metropolitan District", amending
the laws relating to the Maryland National Capital Park and Plan-
ning Commission in order to increase the amount of the ad valorem
tax which may be levied within the Maryland-Washington Metro-
politan District IN MONTGOMERY COUNTY and to except
from the provisions hereof that portion of Montgomery County
included within the Upper Montgomery County Metropolitan Dis-
trict.
Section 1. Be it enacted by the General Assembly of Maryland,
That Section 51 (d) of Chapter 780 of the Acts of the General
Assembly of 1959, said Act having enacted the sub-title "Park and
Planning Commission", and added said sub-title to the Montgomery
County Code (1955 Edition, being Article 16 of the Code of Public
Local Laws of Maryland) and added said sub-title also to the Code
of Public Local Laws of Prince George's County (1953 Edition, be-
ing Article 17 of the Code of Public Local Laws of Maryland), and
said Section 51 (d) being in the sub-heading "Metropolitan District",
be and it is hereby repealed and re-enacted, with amendments, to
read as follows:
51. Taxes to be levied in Montgomery County and in Prince
George's County.
(d) [Three cent tax authorized] Authorized in Montgomery and
Prince George's Counties. The County Council of Montgomery County
and the County Commissioners of Prince George's County are author-
ized in their discretion to levy an ad valorem tax not exceeding -[five
cents (5¢)] IN PRINCE GEORGE'S COUNTY AND seven cents
(7¢) IN MONTGOMERY COUNTY annually, in addition to all other
taxes now levied, for the benefit of and on behalf of the Commission,
upon all of the property within the Metropolitan District now assessed
for County taxation purposes, as the Metropolitan District is now de-
fined or may hereafter be defined at the time of the levy, excepting
therefrom that portion of Montgomery County [not now included
within the said District.] designated as the Upper Montgomery Coun-
ty Metropolitan District by Section 22A of this sub-title. The County
Council and the County Commissioners are authorized to pay the
aggregate amount collected by said tax to the Commission as they
now pay other funds collected by taxation for the benefit of the
