1993 LAWS OF MARYLAND

EXCEPT AS PROVIDED IN SUBSECTION (B) OF THIS SECTION, AN EMPLOYEE
MAY BE PLACED ON PROBATION, IN ACCORDANCE WITH THE REGULATIONS OF THE
SECRETARY, WHEN THE EMPLOYEE IS PROMOTED OR REINSTATED IN THE
CLASSIFIED SERVICE.

(B) EXCEPTION.

AN ADDITIONAL PERIOD OF PROBATION MAY NOT BE REQUIRED FOR AN
EMPLOYEE WHO IS PROMOTED AS A RESULT OF A RECLASSIFICATION OF A
POSITION THAT DOES NOT INVOLVE A SUBSTANTIAL CHANGE IN DUTIES OR
RESPONSIBILITIES.

REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 64A, § 18A and, as it related to probation following
promotion or reinstatement, the first sentence of § 1(15).

In subsection (a) of this section, the phrase "in accordance with the
regulations of the Secretary" is substituted for the former condition "if
required" for clarity.

As to the use of the term "reinstated" in subsection (a) of this section, see §
1-101(k) of this article and its accompanying Revisor's Note.

4-403. PROBATIONARY PERIODS.

(A)     IN GENERAL.

(1)      SUBJECT TO THE LIMITATIONS OF THIS SECTION, THE SECRETARY
BY REGULATION SHALL ESTABLISH PERIODS OF PROBATION FOR ALL POSITIONS IN
THE CLASSIFIED SERVICE.

(2)      THE GRADES OF THE PAY SCALE SPECIFIED IN THIS SECTION ARE
THOSE IN EFFECT ON JANUARY 1, 1993.

(B)     MAXIMUM PERIODS — GRADES 1 THROUGH 6.

(1)      EXCEPT AS PROVIDED IN PARAGRAPH (2) OF THIS SUBSECTION, THE
PERIOD OF PROBATION FOR A POSITION IN GRADES 1 THROUGH 6 OF THE PAY
SCALE MAY NOT EXCEED 3 MONTHS.

(2)      SUBJECT TO THE APPROVAL OF THE SECRETARY, THE APPOINTING
AUTHORITY MAY EXTEND AN EMPLOYEE'S PERIOD OF PROBATION UNDER
PARAGRAPH (1) OF THIS SUBSECTION FOR ONE ADDITIONAL PERIOD NOT
EXCEEDING 6 MONTHS.

(C)     SAME — GRADES 7 THROUGH 12.
