Ch. 10

(1)      EXCEPT AS PROVIDED IN PARAGRAPH (2) OF THIS SUBSECTION, THE
PERIOD OF PROBATION FOR A POSITION IN GRADES 7 THROUGH 12 OF THE PAY
SCALE MAY NOT EXCEED 6 MONTHS.

(2)      SUBJECT TO THE APPROVAL OF THE SECRETARY, THE APPOINTING
AUTHORITY MAY EXTEND AN EMPLOYEE'S PERIOD OF PROBATION UNDER
PARAGRAPH (1) OF THIS SUBSECTION FOR ONE ADDITIONAL PERIOD NOT
EXCEEDING 6 MONTHS.

(D)     SAME — GRADES 13 AND ABOVE.

THE PERIOD OF PROBATION FOR A POSITION IN GRADE 13 OF THE PAY SCALE
OR HIGHER MAY NOT EXCEED 1 YEAR.

(E)     SAME — LAW ENFORCEMENT EMPLOYEES.

EXCEPT AS OTHERWISE PROVIDED BY LAW, THE PERIOD OF PROBATION FOR
LAW ENFORCEMENT EMPLOYEES OF THE MARYLAND STATE POLICE AND THE
DEPARTMENT OF NATURAL RESOURCES SHALL BE AS PROVIDED IN THIS SECTION.

REVISOR'S NOTE: Subsection (a)(1) of this section is new language added to
reflect the authority of the Secretary to establish periods of probation within
the maximums set by statute. See COMAR 06.01.01.37C.

Subsection (a)(2) of this section is new language added to clarify the effective
date for the pay grades indicated in this section. Accordingly, the former
references to grades as they were numbered on January 1, 1967, are revised in
this section to reflect current grade numbers, as specified in COMAR
06.01.01.37C.

Subsections (b) through (d) of this section are new language derived from the
second through fifth clauses of former Art. 64A, § 33(b)(1)(i). They are
revised to reflect COMAR 06.01.01.37.

Subsection (e) of this section is new language added to reflect that probation
periods for certain law enforcement employees are set by other statutes or
regulations. See COMAR 06.01.01.37C(3) and (4).

In subsection (c)(2) of this section, the former phrase "in no event under any
circumstances, including changes of job classifications", is deleted as
unnecessary. See COMAR 06.01.01.37E.
