as security to the aforesaid John Bain their Executors administrators & assigns according to
the condition of said notes or obligations, and also in Consideration of the further sum of one dollar
current money to him the said Thomas K. Smith in hand well & truly paid by the said James R Phillips
before the sealing and delivery of these presents, the receipt whereof the said Thomas K Smith doth hereby
acknowledge, hath granted bargained & sold and by these presents doth grant bargain & sell release
and confirm & assign unto the said James R. Phillips the following property to wit
My undivided interest to all and singular the following Negroes viz:  one negro man Daniel
aged about fifty years, one negro man man called Obediah aged about thirty years one negro
man called Charles aged about twenty four years all slaves for life.  Also my right title and interest
to the following property two Beds Bedsteads and furniture one Mahogany Table, one
side Board thirteen cane seat Chairs ^one Bureau one ward Robe one clock one tunty cart and chairs^ one pair mill scales one Grind Stone one cop cut sair
and one machine Horse power and fixtures.  Also all my right and interest of and unto three
Hogs at the mill.  To have and to hold all and singular the said Negroes property and furniture
and other the premises bargained and sold or mentioned or intended so to be to the said James R
Phillips his Executors administrators and assigns as aforesaid forever.  And I the said Thomas K. Smith
for myself my heirs Executors and administrators All and singular the said Negroes property and
furniture and other the premises unto the said James R Phillips his Executors Administrators
and assigns, against me the said Thomas K Smith my Executors administrators and assigns against
all and every other person or persons whatsoever shall and will warrant and forever defend by these
presents of all and singular which said negroes property and furniture and other the premises by the
said Thomas K Smith hath put the said James R Phillips in full possession by delivering to the said
James R Phillips one side Board at the sealing and delivery of the presents in the name of the whole
property and premises hereby bargained and sold or mentioned or intended so to be unto him the
said James R Phillips as aforesaid.                     In Testimony whereof the said Thomas K Smith
hath set his hand and affixed his seal the day and date first herein before written.

                                              State of Maryland Dorchester County to wit:
       Be it remembered and it is hereby certified that on this 26th day of June 1852.  Before me ^the subscriber^
a Justice of the Peace in and for the County and state aforesaid personally appeared Thomas K Smith
he being known to use to be the person who is named and described as and professing to be the party
grantor to the aforegoing Mortgage Bill of Sale or instrument of Writing and doth acknowledge the said
Mortgage Bill of Sale or instrument of writing to be his act and deed.         In Testimony whereof I
hereunto subscribe my name on the day and year aforesaid

State of Maryland Dorchester County to wit
                        Be it remembered that on this 26th day of June 1852 personally appears before me
the subscriber a Justice of the peace in and for the county and state aforesaid James R Phillips the
Party grantee to the within mortgage Bill of Sale or instrument of Writing and made oath on the
Holy Evangely of Almighty God that the aforegoing mortgage Bill of Sale or instrument of
writing is Bona fide and that it is not received for fraudulent or other improper purposes
